The following two and a half years were a difficult immigration journey, filled with emotional, cultural, and financial difficulties. The constant insecurity of deportation loomed large. Yet, I clung to my dreams. Through faith and the incredible support of my lawyer, Alice, we navigated this challenging process together. Finally, I secured asylum in San Francisco, CA. What does a Family Petition mean?

A family petition is a formal document filed with the United States Citizenship and Immigration Services (USCIS) by a U.S. citizen or lawful permanent resident (green card holder) on behalf of a qualifying family member. This petition establishes the legal relationship between the petitioner (the U.S. citizen or green card holder) and the beneficiary (the family member seeking an immigration benefit).

A successful family petition is typically the first step in the process for a family member to obtain a green card, which allows them to live and work permanently in the United States. It can also be a prerequisite for certain types of U.S. entry visas, such as a K-1 fiancé(e) visa.

Here's a breakdown of the different types of family petitions: Immediate Relative Petitions: These petitions are for the closest family members of U.S. citizens, such as spouses, parents, and unmarried minor children. There is no limit on the number of immediate relative petitions that can be approved each year.

Family Preference Petitions: These petitions are for more distant relatives of U.S. citizens and certain relatives of lawful permanent residents. There are limitations on the number of family preference visas available each year, which can lead to waiting times for beneficiaries.

What is the Possible Outcome of an Affirmative Asylum Case?

An immigration office will interview you for a few hours. She or he will either grant, deny, or refer your application to court. 

  1. Asylum Granted: You'll receive refugee status, allowing you to live and work legally in the US and apply for a green card after one year.
  2. Asylum Denied: If your claim is denied, you will be ordered to leave the country at the end of your legal status, if any.
  3. Refer to an Immigration Court: if your claim is referred to an immigration court, the Asylum office will transfer your file to the Immigration court. At that point your Affirmative Asylum case has ended, and you will start a new Defensive Asylum Case in the manner discussed in section (a) above.

What is the Possible Outcome of a Defensive Asylum Case?

 An immigration judge will hear your case. He will either grant or deny your asylum claim.

  1. Asylum Granted: You will receive refugee status, allowing you to live and work legally in the United States. You can then apply for a green card after one year.
  2. Asylum Denied: If your claim is denied and you still want to stay in the US, you may have options depending on the specifics of your case. These options include appealing the decision within thirty days, filing a motion to reopen, or filing a motion to reconsider. For Affirmative

Where do I file the application Form I-589 Application?

Defensive Asylum Case: If you're in immigration court proceedings (meaning you have received a Notice to Appear or NTA), you'll file your Form I-589 with the immigration court where your case is being heard.

Affirmative Asylum Case: If you haven't been placed in immigration court proceedings and are eligible to apply for asylum directly with USCIS, you can file your Form I-589 online or by mail.

Who can apply for asylum in the US? And What are the eligibility requirements for asylum?

To be eligible for asylum in the United States, you generally need to meet two key requirements:

  1. Fear of Persecution: You must have a well-founded fear of persecution in your home country due to your race, religion, nationality, membership in a particular social group, or political opinion. Persecution refers to harm or threats of harm that are so severe they would violate human rights.
  2. Physical Presence in the U.S.: You must be physically present in the United States and unable to return to your home country due to this fear.

If you believe you meet these criteria, you will need to file Form I-589, Application for Asylum and for Withholding of Removal, within one year of your last arrival in the U.S. While working with an immigration attorney is not mandatory, it can significantly increase your chances of a successful asylum application.
